What To Do Following Your Child's School Bus Accident in Sacramento, CA

October 3, 2024
A row of yellow school buses are parked in a parking lot.

As a parent, one of the scariest phone calls you can receive is hearing that your child has been injured in a school bus accident. In such a stressful and emotional situation, it's important to know what steps to take next. This blog will guide you through the immediate actions to take following your child's accident, the legal options available to you, and why contacting a personal injury attorney is crucial for seeking justice for your child. The sooner you take action, the better your child's situation can turn out.

Immediately After The Accident

When your child is involved in an accident, it will first be reported to the police and medical help may be called for before parents are notified. Parents and legal guardians will be contacted by the school, the police, or other professionals to make them aware of the situation. Even though this is a scary situation for you and your child, try to remain calm. Keep track of all police reports and other documentation as this will be useful as you move forward creating a legal case.

What To Do First

The first thing you should do following your child's school bus injury is ensure their safety and seek medical attention immediately, even if their injuries are mild or if your child doesn't appear to have any injuries at all. Medical attention ensures your child's needs are met and gives you information you can use legally. Once your child receives the necessary care, it's important to gather as much information about the accident as possible. This includes taking photos of the scene, getting contact information from witnesses, and documenting any injuries sustained by your child. While it may be tempting to go directly to the police, it's best to consult with a personal injury attorney first to understand your legal rights.

Who Is Legally Responsible For Your Child's Injury?

In terms of legal action, you may be able to pursue a claim against the school district or bus driver responsible for your child's injuries. You may be able to go after both entities, depending on how severe the accident was. Liability in school bus accidents can be complex and depend on factors such as negligence or mechanical failure, among other things. By consulting with a personal injury attorney who specializes in these types of cases, you can determine who is liable for your child's injury and whether you have grounds for legal action.

Should You Contact An Attorney?

Contacting a personal injury attorney is essential in ensuring that you can create a positive case for your child's case. It also helps ensure that your child receives fair compensation for their accident. A skilled attorney will be able to assess the extent of your child's injuries, both physical and emotional, and work towards securing maximum compensation on their behalf. In addition to medical expenses, your child may be entitled to damages for pain and suffering, emotional distress, and future rehabilitation costs.

What If Your Child Is An Adult?

If your child is an adult in high school at the time of the accident, they may choose to hire an attorney on their behalf. However, as their parent or guardian, you can also assist them in finding legal representation if needed. If your child still lives at home and you are responsible for their care, you may be able to file for legal representation for them entirely, but if you don't know for sure, ask an attorney for advice. Working closely with an experienced personal injury attorney will help navigate the complexities of the legal system and ensure that your child's rights are protected throughout the claims process.

Why Does Fast Action Matter?

Fast action is crucial when it comes to pursuing a claim for your child's school bus accident because the longer you wait to file a case, the weaker your potential case can become. Evidence can quickly disappear, witnesses' memories fade, and deadlines for filing claims can pass if not adhered to promptly. By contacting a personal injury attorney soon after the accident occurs, you give yourself the best chance at building a strong case on behalf of your child.

Dealing with a school bus accident involving your child can be overwhelming and stressful. Knowing what steps to take following such an incident can make all the difference in seeking justice for your child. From seeking medical attention immediately after the accident to contacting a personal injury attorney for legal guidance and representation, taking swift action is key in ensuring that your child receives fair compensation for their injuries. Remember that you are not alone in this process — there are resources available to help you navigate this challenging time and advocate for what is best for your child. Reach out to our team at Frank Penney Injury Lawyers near Sacramento, CA today.

A devastating crash on the 15 Freeway in Temecula late Saturday night left four people dead and two others injured after a BMW M4, allegedly driven recklessly, lost control and caused a head-on collision. The California Highway Patrol reported the crash around 9:33 p.m. when the BMW, traveling north of Winchester Road, swerved left, struck a concrete median, and flew into the southbound lanes. The car veered into the far-right lane and collided head-on with a white Nissan Sentra. The BMW burst into flames moments after impact. Good Samaritans were able to pull the BMW’s driver, a 25-year-old man from Moreno Valley, from the burning vehicle. He suffered major injuries and was rushed to a hospital. Tragically, his passengers did not survive. A 23-year-old woman in the front seat and two Moreno Valley teenagers, a 14-year-old boy and a 15-year-old girl in the back, were pronounced dead at the scene. The Nissan’s driver, a 35-year-old man from Wildomar, was taken to a hospital but did not survive the trip. His passenger, a 22-year-old man, remains in critical condition. Authorities said that alcohol does not appear to have been a factor, but charges against the BMW driver are pending as investigators continue to examine the circumstances surrounding what they describe as reckless driving. As of Sunday afternoon, none of the victims had been publicly identified. A tragic crash on Interstate 80 in Davis claimed the life of 42-year-old Christopher Barr of Dixon early Tuesday morning. According to the California Highway Patrol, the accident happened just before 4:45 a.m. in a construction zone on the eastbound side of the freeway, just west of Mace Boulevard. CHP reported that a Volvo tractor with trailers was traveling in the middle lane when, for reasons still unknown, Barr’s Harley Davidson motorcycle failed to slow down and struck the back of the truck. The impact threw him from the motorcycle, and he was fatally struck by another vehicle that has not yet been identified. Authorities have said that alcohol and drugs do not appear to be factors in the crash. The collision remains under investigation by the California Highway Patrol as they work to determine what led to the fatal chain of events.
