Understanding Common Motorcycle Accident Cases and Reasons You Need To Hire a Lawyer

February 14, 2024

Riding a motorcycle is an exhilarating experience filled with excitement and adventure, but it also comes with significant risks. Despite taking all necessary precautions, motorcyclists are still vulnerable to accidents, and when such accidents occur, lawyers come into play. Moreover, motorcycle accidents usually lead to catastrophic injuries due to the absence of any protection like airbags and seat belts.

Hiring an experienced lawyer after a motorcycle accident is crucial as they can help secure your rights and get you the compensation you deserve. Keep reading to understand common motorcycle accident cases and reasons to hire a lawyer.

Rear-End Collisions

Rear-end collisions are the most common types of accidents that motorcyclists face. It happens when a vehicle hits a motorcycle from behind. Rear-end collisions usually occur when the driver of the vehicle is distracted, driving under the influence, or not maintaining a safe distance. Motorcyclists involved in rear-end collisions can suffer severe injuries such as spinal cord injuries, concussions, brain injuries, paralysis, or even death.

Lane Splitting Accidents

Lane splitting occurs when a motorcyclist rides between two lanes of stopped or slow-moving traffic. The practice is permitted in some states, but riders are required to do so cautiously. Lane-splitting accidents usually occur when a car driver opens a door suddenly or changes lanes without checking for cyclists. Experts recommend that motorcyclists involved in a lane-splitting accident should immediately consult with a motorcycle accident lawyer.

Left-Turning Accidents

Left-turning accidents occur when a car or truck is making a left turn, and a motorcyclist passes straight through the intersection. In such situations, cars often fail to see the motorcycle and often make the turn, hitting the rider. Depending on the speed and position of the accident, injuries could range from minor to life-threatening. It is essential to consult with a lawyer to understand the legal aspects of your situation.

Head-On Collisions

Head-on accidents are rare but result in the most severe forms of accidents. It usually happens when a vehicle crosses the centerline, and the motorcyclist is on the receiving end of the collision. In such cases, the motorcyclist could suffer major head and spinal cord injuries, leading to permanent disabilities and lifelong medical treatments.

Why You Need a Lawyer?

If you have been involved in a motorcycle accident, it is imperative to hire a lawyer who specializes in motorcycle accidents. An experienced lawyer takes care of all legal procedures, helps you obtain the best medical treatment, negotiates with the insurance companies on your behalf, and ensures that you receive adequate compensation for your injuries. They can also guide you through essential steps like filing a claim, gathering evidence, and negotiating a settlement.

Consultations

Consulting a lawyer after a motorcycle accident can significantly influence the outcome of your case. During a consultation, the lawyer will review the facts of your accident, assess any injuries, estimate potential damages, and evaluate the possibility of litigation. This initial meeting is an opportunity for you to share your story, present any evidence, and express your concerns or expectations.

The goal of this consultation is not only for the lawyer to understand your case but also for you to evaluate the lawyer's competence, empathy, approach, and whether you feel comfortable working with them. Therefore, do not hesitate to ask questions regarding their experience, expertise in motorcycle accident cases, and their approach toward clients.

Riding a motorcycle can be a beautiful experience as long as safety precautions are taken. However, motorcycle accidents do happen, and when they do, they often lead to severe injuries. When involved in a motorcycle accident case, it is crucial to seek legal representation from experienced motorcycle accident lawyers.

Understanding the common types of accidents can help you stay safe while on the road. If you have been involved in a motorcycle accident, contact a motorcycle accident attorney today to discuss your legal options and get the compensation you deserve. Your rights are important, and by retaining a lawyer, you give yourself the best opportunity to protect and secure those rights.

A devastating crash in Piedmont, California, that killed three young adults in November 2024 is now being further illuminated by toxicology reports. Nineteen-year-old Soren Dixon, the driver of a Tesla Cybertruck that slammed into a tree and wall at around 3:00 a.m., was found to have a blood alcohol level of 0.195%—more than twice the legal limit—and had cocaine in his system at the time of the crash. The collision claimed the lives of Dixon and two of his passengers, Jack Nelson, 20, and Krysta Tsukahara, 19, all of whom were graduates of Piedmont High School. Dixon had been attending the University of Southern California, Nelson was a student at the University of Colorado Boulder, and Tsukahara was a sophomore at the Savannah College of Art and Design. According to autopsy and toxicology reports, both Nelson and Tsukahara also had alcohol and cocaine in their systems. Nelson’s blood alcohol content was measured at 0.168%, while Tsukahara’s was 0.028%. All three were pronounced dead at the scene and suffered severe burns as a result of the crash. A fourth passenger, identified as 20-year-old Jordan Miller, was pulled from the vehicle by a passing motorist and was hospitalized in stable condition. Miller, a sophomore at the University of Wisconsin, survived the crash and was later identified by his mother. The tragic accident occurred during Thanksgiving break, and authorities believe the group was home visiting for the holiday. In a statement released on Facebook, Piedmont Police expressed their condolences, saying, “Our hearts remain heavy in the aftermath of the tragic vehicle collision,” and thanked the community for its support during a profoundly difficult time.
