Six Things to Do If You Were Hurt in a Boating Accident

Frank Penney • July 25, 2024

Boating accidents, while less common than car crashes, can still have serious and sometimes life-altering consequences. The suddenness of such an event can leave you feeling overwhelmed and unsure of what to do next. Whether enjoying a peaceful day of fishing or engaging in high-speed water sports, it's important to be prepared for unforeseen circumstances. This guide provides you with clear, actionable steps to take in the immediate aftermath of a boating incident. From ensuring immediate safety to consulting with legal experts, these recommendations aim to help you handle the situation effectively, safeguard your rights, and set the stage for a smoother recovery process. By being informed, you can focus on what truly matters: your well-being and that of your loved ones. Here is a comprehensive guide on what to do if you find yourself injured in a boating accident.

1. Ensure Immediate Safety

The first step after any boating accident is ensuring the safety of all individuals involved. Move to a safe location if possible, away from any potential hazards like sinking boats, fire, or fuel spills. If anyone is overboard, use flotation devices to assist them in staying afloat until help arrives. Prioritize your safety and the safety of others before taking any further steps.

2. Seek Medical Attention

Even if your injuries seem minor, it is vital to seek medical attention promptly. Boating accidents can result in various types of injuries, ranging from minor to severe. Four common types of boating injuries include lacerations, fractures, concussions, and hypothermia. Some injuries may not be immediately apparent, and delaying treatment can worsen your condition. Medical professionals can assess your injuries and provide the necessary care. Documenting your injuries with medical records will also be crucial for any subsequent claims or legal actions.

3. Report the Accident

In the United States, it is required by law to report boating accidents to the appropriate authorities, such as the Coast Guard or local marine patrol office. This obligation applies to a wide range of incidents, from minor collisions to more serious accidents involving injuries or significant property damage. Reporting the accident ensures that an official record is created, which could be essential for insurance claims and legal proceedings.

When you report an accident, be prepared to provide comprehensive details about the incident. This includes information about all vessels involved, the nature and sequence of events leading to the accident, and any injuries sustained by passengers or crew members. Additionally, you may need to provide details about weather conditions, visibility, and any other factors that may have contributed to the accident. Timely and accurate reporting not only helps in the resolution of legal and insurance matters but also contributes to broader safety and regulatory oversight, potentially preventing future accidents.

4. Gather Evidence

Collecting evidence at the scene of the accident can significantly support your case if you need to file an insurance claim or pursue legal action. Take photographs of the scene, the boats involved, and any visible injuries. Ensure that the pictures are clear and cover different angles to provide a comprehensive view. Obtain contact information from witnesses, as their testimonies could be invaluable. Ask them for detailed accounts of what they saw and heard. Keep copies of any incident reports filed by authorities or medical personnel. These reports often contain crucial information such as the time of the accident, weather conditions, and initial observations from responders. Documenting every detail meticulously can make a substantial difference in the outcome of your case.

5. Notify Your Insurance Company

Promptly informing your insurance company about the accident is crucial. Provide them with all relevant details and any evidence you have gathered. Your insurer will guide you through the claims process, which can include repairs for your boat and compensation for medical expenses. Cooperate fully with the insurance investigation to ensure a smooth and expedited resolution.

6. Talk to a Lawyer

Legal counsel can be indispensable following a boating accident, especially if there is a dispute or complex legal issues. Such accidents can involve intricate maritime laws and regulations, making it challenging for individuals to navigate the legal system on their own. Consulting a lawyer who specializes in maritime or personal injury law will help you understand your rights and options. They can assist you in negotiating with insurance companies, which often try to minimize payouts, and in filing lawsuits if necessary.

Additionally, a specialized lawyer will advocate on your behalf to secure fair compensation for medical bills, property damage, lost wages, and any pain and suffering endured. They will gather evidence, interview witnesses, and collaborate with experts to build a strong case. A lawyer will ensure all legal procedures are followed correctly, such as meeting filing deadlines and complying with court requirements, thereby helping to protect your interests and mindset during this process.

Navigating the aftermath of a boating accident can be complicated and stressful due to the various factors involved, such as assessing damage, handling injuries, and dealing with insurance claims. By following these six steps, you can address immediate concerns, protect your legal rights, and work toward your recovery with greater confidence. These steps include ensuring everyone's safety, contacting emergency services, documenting the incident thoroughly, notifying your insurance provider, seeking medical attention if needed, and consulting with a legal professional to understand your rights and options. Taking these actions can help you manage the situation more effectively and move forward with peace of mind. A devastating crash in Piedmont, California, that killed three young adults in November 2024 is now being further illuminated by toxicology reports. Nineteen-year-old Soren Dixon, the driver of a Tesla Cybertruck that slammed into a tree and wall at around 3:00 a.m., was found to have a blood alcohol level of 0.195%—more than twice the legal limit—and had cocaine in his system at the time of the crash. The collision claimed the lives of Dixon and two of his passengers, Jack Nelson, 20, and Krysta Tsukahara, 19, all of whom were graduates of Piedmont High School. Dixon had been attending the University of Southern California, Nelson was a student at the University of Colorado Boulder, and Tsukahara was a sophomore at the Savannah College of Art and Design. According to autopsy and toxicology reports, both Nelson and Tsukahara also had alcohol and cocaine in their systems. Nelson’s blood alcohol content was measured at 0.168%, while Tsukahara’s was 0.028%. All three were pronounced dead at the scene and suffered severe burns as a result of the crash. A fourth passenger, identified as 20-year-old Jordan Miller, was pulled from the vehicle by a passing motorist and was hospitalized in stable condition. Miller, a sophomore at the University of Wisconsin, survived the crash and was later identified by his mother. The tragic accident occurred during Thanksgiving break, and authorities believe the group was home visiting for the holiday. In a statement released on Facebook, Piedmont Police expressed their condolences, saying, “Our hearts remain heavy in the aftermath of the tragic vehicle collision,” and thanked the community for its support during a profoundly difficult time.
