Factors That Affect the Value of Personal Injury Claims

September 29, 2022

A personal injury often causes not only physical and emotional pain but also financial losses. That's why fair compensation should be your priority immediately after you sustain a personal injury. The different effects of personal injuries and other related aspects can determine the amount of compensation you receive.

Learn about factors that affect personal injury settlements.

The Litigation Costs

Litigation costs are all expenses you will incur during the injury claim process. The costs can add up and strain you financially if you lack a good budget. Common litigation costs in personal injury cases are:

  • Exhibits
  • Court filing fees
  • Court reporter expenses and depositions

A professional injury attorney will discuss the litigation costs with you and break them down for you upfront. As a result, you will know what to pay for to maximize your injury claim value.

The Injury Severity

Accidents, especially auto-related ones, cause different types of injuries, which come with varying severities.

More severe bodily injuries, like spinal cord damage and fractured bones, often cause more suffering and pain to victims, so they increase the settlement value. Also, more severe injuries have extended recovery periods, which make them attract higher compensation. Lastly, some injuries, like brain trauma and loss of body limbs, can cause permanent or total disability, which makes victims receive higher settlements.

The Lost Income and Opportunities

A personal injury can cause you to take an early and unpaid leave, which will affect your wages and other opportunities. For instance, you can miss a promotion or workers' bonuses that might come when you are on leave. Whether you've taken unpaid leave or lost your job due to a personal injury, your compensation should factor in your lost earnings and opportunities.

But, you must give the court relevant documents about your lost earnings to recover fair compensation. Keep track of the days you've been out of your job or work with your organization's human resource department to determine the accurate income you've lost.

The Distress You Face

A personal injury can subject you to psychological issues like post-traumatic stress disorder (PTSD), depression, and anxiety. Such psychological problems can cause emotional trauma and affect your mental health in the long run. The psychological and mental injuries you endure from an accident can increase the value of your injury claim.

A psychiatrist is essential in your injury claim to prove to the court the emotional trauma you've suffered.

The Treatment Cost

The type and extent of treatment you get after a personal injury will be a factor of consideration in your claim's evaluation. Your compensation should include all medical expenses, from prescription medication and follow-up treatments, to travel expenses due to hospital visits.

You must provide correct medical records to the court to show that the injury you seek compensation for isn't from a pre-existing condition. To avoid unnecessary inconveniences during your claim, seek medical help immediately after you sustain a personal injury.

The At-Fault Party

The laws of different states regarding the effect of liability on the compensation of personal injury victims vary. But mostly, you will receive if the defendant is majorly or entirely responsible for your injuries.

Contributory fault and comparative fault rules help insurers determine whether injury victims deserve compensation. Pure contributory fault rules will only favor you if you don't carry any blame for your injuries. Pure or modified comparative fault rules will favor you even if you are responsible for some of your injuries.

A devastating four-vehicle crash on Highway 1 near Rancho San Julian claimed the lives of three teenagers and left two adults with major injuries on Sunday evening. The collision happened just after 6 p.m. along the stretch of highway between Lompoc and Gaviota, drawing response from the Buellton California Highway Patrol, Santa Barbara Sheriff’s Office, and Santa Barbara County Fire Department. Investigators say a 2007 Toyota Yaris, heading southbound, veered into the northbound lane and collided head-on with a 2024 Tesla Model 3. The impact pushed the Tesla into a 2012 Audi Q5 traveling south, and a fourth vehicle, a 2002 Honda Accord, was also hit. Tragically, all three people inside the Toyota Yaris died at the scene. The victims have been identified as 18-year-old Jake Curtis of Goleta (the driver), and passengers Michael Ochsner, 17, and Alexander Wood, 15, both of Santa Barbara. All three were students at Dos Pueblos High School and worked as lifeguards for Santa Barbara County. The two individuals in the Tesla, 54-year-old physician Hafez Nasr and 53-year-old Saghar Golpayegani, both of Lompoc, sustained major injuries. Nasr was transported by ambulance, while Golpayegani was airlifted by CalStar helicopter to Santa Barbara Cottage Hospital for treatment. The drivers of the Audi and Honda—Luke Karmen, 16, and Daniel Switzer, 17, both high school students from Santa Barbara—suffered minor injuries. “This was a tragedy, and local families have lost loved ones,” said Lieutenant Jason Bronson, Commander of the Buellton CHP Area. “We grieve with the families and work every day to prevent this loss of life in our communities.” The crash remains under investigation. Authorities ask anyone with additional information to contact the Buellton Area CHP office at (805) 691-6160. Highway 1 was temporarily closed in both directions but has since reopened. A tragic scene unfolded on May 9 in Stockton when a pedestrian was fatally struck in a hit-and-run incident. The California Highway Patrol responded just after noon to Wilson Way, just south of Belvedere Avenue, where they found a man who had been hit by a vehicle. Sadly, the man later succumbed to his injuries. Thanks to quick witness accounts, officers were able to identify a description of the suspect vehicle. They traced it to a home on Vine Street in Stockton, where the car showed clear signs of damage consistent with the crash. The driver was taken into custody and now faces serious charges, including vehicular manslaughter and fleeing the scene of an accident. Authorities later identified the victim as 54-year-old James Kendrix Jr., according to the San Joaquin County medical examiner. This heartbreaking event serves as a reminder of how quickly lives can be lost due to reckless driving and the importance of staying at the scene of an accident. Anyone affected by a similar tragedy should know that help is available to pursue justice and hold responsible parties accountable. A tragic crash in Elk Grove early Tuesday morning claimed the lives of two 21-year-olds. According to the Elk Grove Police Department, the crash happened around 5:03 a.m. on the northbound side of Waterman Road, just south of Sheldon Road. Authorities say the male driver lost control of the vehicle and struck a light pole on the east side of the road. Both the driver and his female passenger were pronounced dead at the scene. Emergency crews responded quickly, and the area was temporarily closed off for investigation. The roadway was fully reopened by 10:45 a.m. While the exact cause of the crash remains unclear, investigators believe speed likely played a role. At this time, it’s unknown whether drugs or alcohol were involved. The incident remains under investigation.
