7 Common Personal Injury Claims

Frank • Feb 24, 2022
Did you know that 35 million emergency room visits result from personal injury-related cases? Millions suffer personal injuries each year due to negligent parties. Unfortunately, many people do not know they can file for compensation for personal injuries caused by negligent individuals and medical errors. Explore seven common personal injury claims that you can file.

1. Car Accident Claims

Millions of Americans are injured in car accidents caused by negligent drivers every year. These accidents may be caused by driving under the influence, texting and driving, or overspeeding. For this reason, car accident claims are very common in the United States.

It may be hard to determine who was at fault in some accident cases. Therefore, accident victims must have good legal representation. Drivers found liable in a personal injury lawsuit must pay the victims financial compensation.

2. Wrongful Death

When an individual dies because of another's negligence, the deceased's family may file a wrongful death claim. A wrongful death suit may result from medical malpractice, construction accidents, motor vehicle accidents, airplane crashes, or nursing home neglect. Compensation for a wrongful death claim differs from compensation for non-fatal injuries. New Paragraph

3. Slip and Fall Accident Claims

Slips and falls are another common personal injury claim. If a slip and fall on another person's property results in an injury that costs you financially or results in income loss, you can claim compensation for the accident. However, to win your claim, you should be able to prove that hazardous conditions on the property caused the fall.

4. Workplace Injury Claims

When an employee sustains an injury at their workplace, they can file a compensation claim. According to California workers' compensation laws, if the injured party dies, their dependents are entitled to compensation. Common causes of workplace accidents include unsafe working conditions, faulty equipment, or inadequate training.

Hiring an attorney with experience in workplace injury claims will ensure your rights are protected. A good attorney will also guide you through the entire claim process.

5. Dog Bite Injury Claims

While dogs are beloved pets, they can sometimes pose a danger. Over 4.5 million Americans are bitten by dogs each year, and 1 in 5 among those require medical treatment. In most cases, dog owners are held responsible for dog bite injuries.

The challenge in dog bite injury claims is proving that the owner knew that their dog was dangerous. To do this, you want representation from a personal injury attorney who has handled previous dog bite cases.

6. Product Liability Claims

Defective products can cause consumers serious harm. Incorrect labels and operation manuals can also cause injuries. In such cases, injured parties are entitled to financial compensation. Liable parties in product liability claims include people, companies, or government entities that manufactured, supplied, or sold the product.

Your attorney will evaluate the product in question during a product liability claim and identify the responsible parties. This will help you have a solid case and maximize your compensation.

7. Burn Injury Claim

Burn injuries are painful and traumatic and may be costly to treat. Apart from the pain and treatment costs, burns may result in permanent scars that harm victims' self-confidence. Some common causes of burn injuries include workplace accidents, motor vehicle accidents, construction accidents, and defective products.

You can file a compensation claim if you or a family member has sustained burn injuries due to a negligent party. Before filing the claim, make sure to secure legal representation from a personal injury lawyer to maximize your chances of winning.

The California Highway Patrol has identified the victim of a tragic crash on Highway 1 near Black Road on Wednesday evening as a 28-year-old man from Santa Maria. According to the CHP's report, evidence indicates that the Santa Maria man was driving northbound on Highway 1 in a 2010 Ford when the accident occurred. Initial findings suggest that he collided with a parked harvesting trailer on the east shoulder, then continued northward and collided with another parked harvesting trailer. In the second collision, the man's vehicle became trapped under the trailer, resulting in fatal injuries to the driver. Emergency crews responded promptly to the scene, but the victim was pronounced dead by medical personnel upon arrival. The CHP has stated that the investigation into the crash is ongoing, and at present, the driver's impairment status has not been determined. Late Saturday morning, tragedy struck on Pine Boulevard as an unidentified woman lost her life in a pedestrian crash. The incident unfolded around 11:00 a.m. on April 13th, on the northbound lanes of the road, just south of Rocky Pass. Details indicate that a 36-year-old male was operating a 2016 Ford F-550 heading northbound when, for reasons yet unknown, the vehicle veered off the road, striking a woman walking along the shoulder. Despite the efforts of emergency responders, the 61-year-old female pedestrian was pronounced dead at the scene. Authorities have refrained from disclosing her identity pending notification of her next of kin, handled by the San Diego County Medical Examiner’s Office. In response to the collision, emergency services closed off the surrounding roadway to facilitate cleanup and initial procedures. Throughout the aftermath, the driver of the Ford F-550 remained on-site and cooperated with law enforcement. Initial assessments suggest that alcohol or drugs were not contributing factors in the tragic event on Pine Boulevard. Nevertheless, investigations into the incident are ongoing. In a tragic turn of events on the evening of April 19th, Fernando Porras Abrego found himself under arrest following a fatal DUI crash along Valley Center Road. The incident unfolded around 8:20 p.m. near the intersection with West Tribal Road. The collision proved fatal for the young Camry driver, who succumbed to his injuries at the scene. Authorities have withheld his identity pending notification of kin. Remarkably, Abrego, aged 34, emerged from the accident unscathed. However, law enforcement swiftly took him into custody, transporting him to Vista Detention Facility on DUI-related charges.
